Obligations of the purchaser

The Customer is forbidden to provide false and/or fictitious data in the registration procedure required to activate the process for the execution of this sales agreement and the related further communications; master datae the e-mail addressmust be exclusively real personal data.

In the case of orders placed through www.santero.it, the information contained in the General Terms and Conditions must be viewed and accepted by the customer before the purchase order is sent.

Acceptance will take placeby marking the space provided on the site. Failing this, the order cannot be executed.

Shipping methods

Shipping methods for those placing an order directly with SANTERO S.p.A. will bevia express courierusing the best national couriers.

In order to guarantee a shipment service with a tracked express courier with the best price-quality ratio, the shipment is standard: within 48 working hours after the order has been dispatched to our warehouses, the dispatch service will send you an e-mail with a link to access the tracking of the shipment so that you can obtain real-time updates on the delivery.

Although the forwarding agent is provided with your telephone number to contact you, we cannot guarantee that you will be contacted by telephone as the forwarding service is external to our systems and therefore telephone contact will only take place at the discretion of the driver who will physically handle the delivery.

The shipping cost isEuro 9.00for destinations on the Italian mainland and larger islands, but is fully paid for by SANTERO S.p.A. (free shipping).

All shipments are dispatched by express courier, which takes approximately 48 hours to deliver the goods.

The approximate delivery time varies from 2 to 3 working days (excluding Saturdays, Sundays and holidays) for mainland Italy and 3-5 days for the islands.

SANTERO S.p.A. reserves the right to take the appropriate actions to collect the credit, including mandating recovery to specialised companies, charging late payment interest, charging legal fees, varying the terms of payment. It is understood that delivery of the products will be subject to payment by the Customer of the relevant price in the manner made available by SANTERO S.p.A.

Back-orders (inventories)

SANTERO S.p.A. will handle any products requested,not immediately available from stock(back-order), with absolute priority, to minimise waiting times.

For greater transparency, the actual availability of goods or any waiting time is indicated when browsing the www.santero website.

Delivery will take place in a lump sum: before sending the order, the customer may decide whether to continue with the purchase (and thus wait for full availability of the goods in our warehouse) or to remove such unavailable products from the shopping cart.

Returns management and right of withdrawal

Article 1: Right of Withdrawal

Pursuant to Legislative Decree no. 206/2005 and subsequent amendments, concerning the protection of consumers in distance contracts, SANTERO informs the Customer of the following:

a) The customer may exercise the right of withdrawal within 14 days of receipt of the ordered goods for any reason whatsoever, without explanation and without penalty;

b) The right of withdrawal may only be exercised by a customer who purchases goods for purposes unrelated to his or her economic and business activity and who provides his or her tax code for invoicing purposes and not his or her VAT number;

c) the right of withdrawal must be exercised by the Customer, within the term set forth in point a), by notice to Santero Spa by registered letter with return receipt to our registered office

The right of withdrawal is excluded in the following cases, pursuant to Art. 59 of Legislative Decree 21/2014:

- order of customised or clearly customised products;

- order of products that are likely to deteriorate or expire rapidly;

- order of sealed Products that are not suitable for return for hygienic or health protection reasons or that have been opened after delivery.

The clauses concerning the exercise of the right of withdrawal, as well as their consequences and exceptions, apply exclusively to the User who qualifies as a consumer, i.e. the User acting for purposes outside his or her business or professional activity.

1.2 Content of the declaration of withdrawal

The declaration of withdrawal communicated by the customer must necessarily contain:

(a) a clear and precise reference to the order for which the withdrawal is to be exercised;

b) the express declaration of the Customer's wish to withdraw in whole or in part from the purchase contract;

d) in the case of reimbursement by bank transfer, the bank details of the current account where the Customer intends to receive the relevant reimbursements.

1.3 Obligations of the Customer

The Customer undertakes to keep and guard the products for which he intends to exercise the right of withdrawal with the diligence of a good family man, keeping them intact in their original packaging together with all the accessories and documentation with which they are accompanied.

1.4 Return of Goods

The Customer undertakes to return the products for which the right of withdrawal has been exercised within and no later than 15 days from the communication of his intention to withdraw. The products must be sent to the Seller's operational headquarters, i.e. to Santero Spa, Via Cesare Pavese 28, 12058 Santo Stefano Belbo - Italy. The return of products that are not intact, damaged or missing components and/or accessories, including documentation, shall not be accepted by the Seller Company, which shall return the goods to the Customer with additional transport costs. In such circumstances, the Customer may not avail himself of the right of withdrawal.

1.5 Reimbursement

Santero will refund the Customer the value of the products for which the right of withdrawal has been exercised, including any shipping costs, within 14 days of receipt of the goods under the terms and conditions set forth above. Shipping costs for the return shall be borne entirely by the customer.

Reimbursement will be made using the same method of payment used by the Customer, unless the Customer has expressly requested a different method.

1.6 Damage and Deterioration

Under no circumstances may the Customer exercise the right of withdrawal if the goods are damaged and/or deteriorated, worn out / partially worn out.

Article 2: Return

Free refund or replacement guarantee for defective or mismatched products.

No claims can be considered after 14 days of receipt of the goods and if the material is not returned in its original packaging. If these requirements are not met, the goods shall be returned to the sender freight collect. Pursuant to Presidential Decree no. 472 of 14/08/96, the returned material must necessarily be accompanied by a transport document containing the number and date of the document relating to the disputed product. For anything not expressly provided for in these general terms and conditions, the rules of the Civil Code shall apply. SANTERO SPA, reserves the right to make any changes to the original commercial proposal without any commitment or notice.

Traceability of products sold

On all products handled by SANTERO S.p.A. and especially those regulated by regulations, total traceability of the items sold is guaranteed.

Storage Conditions

Inputs and outputs of material from SANTERO S.p.A.'s warehouse follow the FEFO (First Expired First Out) logic in order to control and guarantee the expiry date and freshness of the products.

The entire warehouse isfully air-conditioned, to ensure appropriate storage conditions for the treated products. The temperature is controlled according to the law or according to the manufacturer's instructions. Maximum attention is paid to the state of preservation of the products both during storage and dispatch.

Packaging features

The products will be packed and shipped with the utmost care and safety, respecting the environment and hygiene.

Goods control

At the time of delivery and in the presence of the carrier, the Customer and/or the Customer's agent collecting the goods will be required to check the integrity of the packages delivered and their relative number, reporting in writing any discrepancies in the number and/or integrity of the packages in the space reserved in the transport document (Delivery Note), which will be duly signed and will remain with the carrier. Having done so, the Customer must contact SANTERO S.p.A. to report any problems within 10 days of delivery.

In the event of non-compliance of the goods due to discrepancies in the number, type and/or integrity of the same, SANTERO S.p.A. at its own expense, will send a new complete supply of the products covered by the purchase order, reimbursement of the price already paid being excluded.

Products

The product pictures and information contained in the information sheets correspond to the actual characteristics of the products, as indicated by the Manufacturer or Supplier to the Seller.

The information on product labels may vary for reasons beyond our control, so there may be discrepancies between the information on the website and the products purchased. The customer should always check the information on the product before consumption or use.

Products will not be supplied on trial.

The customer will be responsible for the choice of products ordered.

The information provided on or via this site should be used for general information purposes only and not as a substitute for any form of advice.

Decisions based on such information are made by the user at his or her own risk and for his or her own account. No rights can be derived from the information contained on this site.

Invoicing

In order to receive an invoice, it is necessary to have entered the invoicing data at the time of purchase, otherwise it will not be possible for us to issue invoices at the customer's request post-sale.

Payments in electronic form

Payments made by credit card, or other electronic forms, will be made through a secure connection, relying on the Visa, Mastercard service. The Customer will pay for purchases by Credit Card without sharing financial information with SANTERO S.p.A., which therefore cannot be held liable for any fraudulent use of the card in question. Problems navigating the site

The Customer shall provide himself/herself with equipment and software suitable for connection to the Internet. Should the Customer no longer be able to view part or all of the site www.santero.it no charge or responsibility may be attributed to SANTERO S.p.A. . SANTERO S.p.A. does not guarantee that the Site www.santero.it functions without errors or interruptions. Any use of this website that may prevent its use by other Internet users, compromise its functionality and/or affect the information provided on or through it or the underlying software is prohibited. SANTERO S.p.A. will not be held liable for any damage, direct or indirect, arising in any way from access to this website and/or (from the use of) information provided on or through the website. SANTERO S.p.A. reserves the right to change the information provided on the website www.santero.it or through it, including the terms of this Disclaimer, at any time and without notice. SANTERO S.p.A. shall not be held liable for the content of external websites that have a link to this website or that link to this website.

Force majeure

SANTERO S.p.A. shall not be held liable towards the Customer for delays or failure to perform contractual obligations caused, directly or indirectly, by force majeure events beyond its control, such as: particularly severe natural phenomena, pandemics, health emergencies, war events, strikes, unforeseen restrictions ordered by the authorities, etc. In such cases, the party concerned shall promptly notify SANTERO S.p.A. of the event. In any case of force majeure, the parties shall be entitled to cancel the order agreement or request its performance within a term to be set.

Limitations of liability

SANTERO S.p.A. accepts no liability for disruptions attributable to force majeure that prevent, in whole or in part, the execution of the sales agreement within the agreed timeframe.

SANTERO S.p.A. will not be liable to any party for damages, losses and costs incurred as a result of failure to execute the sale agreement for the above-mentioned causes, or for damages, losses and costs incurred as a result of the use or impossibility to use the purchased products, the Customer only being entitled to the possible refund of the price paid, excluding any shipping costs.

SANTERO S.p.A. may not be held liable for the loss or damage suffered by the Customer due to delays, slowdowns and interruptions of the e-commerce service if these events are not dependent on its own conduct or are caused by the malfunctioning of telecommunications services.

SANTERO S.p.A. may not be held liable for delays in the execution of the purchase order or failure to execute it if such situations are caused by impediments beyond its control.

The description of the products on the site is for purely commercial purposes and does not imply any recognition or certification of the real effectiveness of the products. Moreover, SANTERO S.p.A. does not guarantee the real validity and usefulness of the products on the website and therefore cannot be held liable for the non-occurrence of the effects reported in the descriptions and/or on the packaging. SANTERO S.p.A. is not responsible for damage caused by improper use of the products on the website.

Suspension of service

SANTERO S.p.A. reserves the right to suspend the visibility of the Site in all or even only part of its functions in relation to all needs connected to its efficiency and security. In these cases SANTERO S.p.A. , except for reasons of particular urgency, will notify customers by any means deemed appropriate and as soon as possible.

Intellectual Property Rights

All figurative or nominative trademarks, and all other signs, trade names, service marks, word marks, trade names, illustrations, images, logos appearing on the site are and remain the exclusive property of SANTERO S.p.A. and are protected by current trademark laws and relevant international treaties.

Age requirements

Users declare that they are of legal age according to the legislation applicable to them.

Under no circumstances may minors under 16 years of age use www.santero.it.

The User who makes a purchase via www.santero.it also declares and warrants that the person who will receive the shipment of the purchased products is of legal age according to the legislation applicable to the latter.

Jurisdiction and applicable law

The sales contract between SANTERO S.p.A. and the Customer shall be deemed concluded in Italy and governed by Italian law. For the solution of civil disputes arising from the conclusion of this distance sales contract, the territorial jurisdiction shall be exclusively that of the Court of Asti.

Acceptance of General Terms and Conditions

By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the General Terms and Conditions of Payment. Therefore, in accordance with Articles 1341 and 1342 of the Italian Civil Code, the Customer declares that he/she has carefully read the General Conditions set out above in all its points and, after careful re-reading, expressly accepts all of them.
